Customer Purchase Agreement

Effective Date: 1 September 2025

Parties:
– RTD Motorsports (“we,” “us,” “our”)
– Customer (“you,” “your”)

1. Purchase & Delivery

• All orders are shipped exclusively with DHL Express.
• Standard delivery times are 3–5 working days, starting from the moment the shipment is collected by DHL Express from RTD Motorsports until delivery to your address.
• Delivery times may vary due to customs procedures, import regulations, or delays in your payment of DHL charges (import duties, VAT, handling fees).
• RTD Motorsports is not responsible for delays caused by customs clearance or failure to promptly settle DHL charges.

2. Refusal of Delivery

If you refuse delivery of any product made by RTD Motorsports shipped via DHL Express:

1. Refund Requests (Optional):
   If you wish to receive a refund, you must email sales@rtd-motorsports.com with your order number to initiate the process.
2. Customer Responsibility (Always):
   Regardless of whether you request a refund, by refusing delivery you agree that you are responsible for all costs incurred, including:
   • The original outbound shipping cost
   • Any import duties/taxes in your country
   • The return shipping cost back to RTD Motorsports
   • Any import duties/taxes when the shipment is received back by RTD Motorsports
   • Non-refundable payment gateway processing fees (approx. 5% of the Total Price Paid)
3. Refund Calculation (If Requested):
   Any refund issued will equal the Total Price Paid minus the above costs.

   Example (Italy):
   Total Price Paid: $550
   Outbound shipping: $47
   Italy import tax: $50
   Return shipping: $85
   Import tax when received back by RTD Motorsports: $40
   Payment gateway fee (5%): $27.50
   Refund = $550 – ($47 + $50 + $85 + $40 + $27.50) = $300.50

3. Return & Refund Policy (Voluntary Returns)

RTD Motorsports accepts voluntary returns under the following conditions:

• Eligibility:
  • The product must be unused, unscratched, and in its original packaging.
  • The return request must be made within 14 days of delivery to you.
• How to Initiate (Required):
  Email sales@rtd-motorsports.com with your order number to obtain return instructions and authorization. Returns without email authorization may be refused.
• Customer Responsibilities:
  • You must arrange and pay for the return shipping from your country to RTD Motorsports.
  • You must also cover (or reimburse RTD Motorsports for) any import duties/taxes charged in our country when DHL delivers the product back.
• Inspection & Refund Conditions:
  • Upon receipt, RTD Motorsports will inspect the product.
  • If confirmed unused, unscratched, and in original packaging, we will refund the Total Price Paid minus shipping, duties, and non-refundable payment gateway fees.
  • If the product is used, scratched, damaged, or missing original packaging, no refund will be issued.

4. Governing Law

This Agreement is governed by and construed under the laws of the RTD Motorsports’ country of operation, without regard to conflict of law principles.

5. Entire Agreement

This document represents the entire agreement between RTD Motorsports and the Customer regarding purchase, delivery, and returns. If any provision is found invalid, the remaining provisions remain fully enforceable.
